CONDITIONS OF USE

1. Acceptance of the conditions
The customer recognizes to have acquainted, at the time of the signing of command(order), particular conditions of sale expressed on this screen and expressly declares to accept them without reserve.
The present general conditions of sale govern the contractual relations between Celtitudes and his(her) customer, both parts(parties) accepting them without reserve.

4. Delivery
The delivery will be made by our carriers in Metropolitan France, and abroad.
The delivery is made in the time slot foreseen(planned) with the customer by the direct discount(delivery) of the product for the announced addressee, is in case of absence, to another person authorized by the customer.
The possible delays do not give the right to the buyer to demand damages.
In the cases of a technical product, the customer will particularly watch to verify the good functioning of the delivered device, to read the note of employment(use) which is supplied to him(her).

5. Retraction You have 7 days (as from the reception of articles) to be made an opinion.

6. Price(prize,prices,prizes) The price(prize) is expressed in euro.
The price(prize) indicated on product sheets does not include the transport.
The price(prize) indicated in the confirmation of command(order) is the definitive price(prize), expressed inclusive of all taxes and including the VAT.
This price(prize) includes the price(prize) of products, the costs of handling, packaging and preservation(conservation) of products, the costs of transport and starting.
7. Payment The price(prize) charged to the customer is the price(prize) indicated on the confirmation of command(order) sent by Celtitudes.
The price(prize) of products is payable in cash in the daytime of the actual command(order).
The payment is made:
- On-line: by means of the system of coded payment of Celtitudes.
- By telephone: in 02 97 40 73 19.
- by mail: check, bank card carrying(wearing) the abbreviation CB, or mandate.
The command(order) validated by the customer will be considered actual only when the centres of banking payment concerned will have given their agreement.
In case of refusal of the said centre, the command(order) will automatically be cancelled and the customer prevented(warned) by e-mail.
Besides, Celtitudes reserves the right to refuse any command(order) of a customer with whom would exist a dispute.

8. Disputes The present contract is subjected to the French law.
Celtitudes cannot be considered as person in charge of the damages of all kinds, so material as immaterial or physical, who could result from a bad functioning or from a misuse of the marketed products.
It's the same for the possible modifications of products resulting from manufacturers.
The responsibility of Celtitudes will be limited, in any case, to the amount of the command(order) and would not know how to be questioned For simple errors or omissions which would have been able to remain in spite of all the precautions taken in the presentation(display) of products.
In case of difficulties in the application of the present contract, the buyer has the possibility, before any action(share) in justice, of looking for an amicable solution notably with the help(assistant):
- Of a professional association of the branch
- of consumers' association
- or of quite other advice(council) of its choice
It is called back(reminded) that the search(research) for the amicable solution does not interrupt the " brief period(delay) " of the legal guarantee, nor the duration of the contractual guarantee.
It is called back(reminded) that as a general rule and subject to the appreciation of the Courts, the respect for the capacities(measures) of the present contract relative to the contractual guarantee supposes:
- That the buyer honors his financial commitments to the salesman

9. Guaranteed In any hypothesis, the customer benefits from the legal guarantee of eviction and from the latent defects (Art. 1625 and following ones of the Civil code).
On condition that the buyer gave evidence of the hidden defect, the salesman legally has to repair all the consequences (art 1641 and following ones of the civil code); if the buyer addresses the courts, he has to make him(it) for the " brief period(delay) " as from the discovery of the hidden defect (art. 1648 of the civil code).

The e-mail address of the customer allows Celtitudes to confirm the commands(orders) of the customer, as well as all the answers which would be given to the telephone by customer services.
The banking information of the customer (number of bank card, dates validity) is coded by the system SSL. They are inaccessible by a third(third party).
